These Terms & Conditions (“Terms”) apply to all services provided by Clearpath Recovery & Transport (“we”, “us”, “our”).

By booking or using our services, you agree to these Terms.

1. Definitions

“Customer”, “you”, “your” – the person requesting our services.

“Vehicle” – any car, van, 4x4 or other item we recover/transport/store.

“Services” – recovery, accident recovery, breakdown recovery, transport, storage, release and related services.

“Storage Yard” – our secure yard facility where vehicles are kept.

2. Bookings & Callouts

2.1. A booking is confirmed once you request a recovery/transport and we dispatch a driver.

2.2. Prices may vary depending on location, vehicle condition, time of day and job type.

2.3. We reserve the right to request payment or a deposit before attending.

2.4. If you provide incorrect information (location, access, vehicle size/condition), additional charges may apply.

3. Cancellations

3.1. If a callout is cancelled after our driver is dispatched, a cancellation fee will apply.

3.2. If we arrive on scene and the job cannot be completed (e.g., wrong info, unsafe conditions), the callout fee still applies.

4. Recovery & Transport Services

4.1. We will take reasonable care in loading, transporting and unloading your vehicle.

4.2. We may refuse to recover or transport a vehicle if it is unsafe, unstable or poses a risk to staff or the public.

4.3. You are responsible for ensuring that the vehicle is in a condition safe to transport, unless the damage is accident-related.

4.4. We are not liable for:

\t•\tPre-existing vehicle damage

\t•\tHidden mechanical issues

\t•\tSuspension, gearbox or drivetrain damage during winching (common on non-runners)

\t•\tDamage caused by loose items inside the vehicle

\t•\tDamage caused by under-body recovery if no safe towing points exist

5. Accident Recovery

5.1. After an accident, you may instruct us directly without notifying your insurer first.

5.2. You authorise us to:

\t•\tRecover your vehicle

\t•\tTransport it to a destination or storage yard

\t•\tStore it securely

\t•\tRelease it to you, your insurer or an authorised company

5.3. We may collect:

\t•\tPhotos

\t•\tVehicle condition records

\t•\tRecovery details

\t•\tInsurance information

These may be shared with your insurer.

6. Storage Terms

6.1. Storage begins as soon as your vehicle enters our yard.

6.2. Storage is charged daily (or part-day) at our current rate.

6.3. Additional fees may apply for:

\t•\tEnvironmental issues (fluid leaks)

\t•\tSecure isolation for damaged EVs

\t•\tExtra labour required to unload or move the vehicle

\t•\tKey handling and document handling

6.4. Vehicles are stored in a gated, CCTV-monitored area, but we are not liable for unforeseen events such as vandalism, severe weather, or third-party damage beyond our control.

7. Release of Vehicles

7.1. Vehicles will only be released when all outstanding charges are fully paid.

7.2. Proof of identity is required before a vehicle is released.

7.3. We may release the vehicle to:

\t•\tAn insurance company

\t•\tA salvage agent

\t•\tA repair centre

\t•\tAny person you authorise in writing

7.4. Keys are only released to authorised persons.

8. Insurance Work & Charges

8.1. When recovery or storage relates to an insurance claim, we may invoice the insurer directly.

8.2. You remain responsible for charges if:

\t•\tYour policy does not cover recovery or storage

\t•\tYou provided incorrect insurance details

\t•\tExcesses or deductibles apply

8.3. We follow ABI-recognised recovery and storage rates.

9. Payment Terms

9.1. Payment is due immediately upon completion of the job unless agreed otherwise.

9.2. We accept:

9.3. Late payments may incur additional charges or interest.

10. Access & Safety

10.1. You must ensure safe access to the vehicle for loading/unloading.

10.2. We may refuse or delay recovery if:

\t•\tThe vehicle is inaccessible

\t•\tWeather or road conditions prevent safe recovery

10.3. We are not responsible for delays caused by traffic, weather, or police restrictions.

11. Property Inside Vehicles

11.1. We are not responsible for items left inside the vehicle.

11.2. Personal belongings should be removed before transport where possible.

11.3. Any valuables or loose items are transported at your own risk.

12. Liability

12.1. Our liability is limited to direct damage caused by our negligence.

12.2. We are not liable for:
